🚨DOT Publishes Proposed Changes to Drug & Alcohol Testing Regulations

Today’s Federal Register includes a new Notice of Proposed Rulemaking (NPRM) from the U.S. Department of Transportation. These proposals, if adopted, would bring significant updates to Part 40 drug and alcohol testing regulations.

Here are a few highlights:
✅ Fentanyl & Norfentanyl would be added to the testing panels
✅ Lower morphine cutoff for urine confirmatory tests
✅ New rules for oral fluid testing (including a new “fatal flaw”)
✅ Collectors, STTs & BATs would have 30 days to complete training/mock collections
✅ Biomarker testing could be authorized
✅ Plus clarifications for SAPs, shy bladder/dry mouth, and other technical updates
